Consumer protection is the practice of safeguarding buyers of goods and services, and the public, against unfair practices in the marketplace. It deals with customer complaints relating to false or misleading representations, unconscionable conduct as well as supply of unsafe, defective and unsuitable goods. Consumer protection laws are intended to:

a) Prevent businesses from engaging in fraud or specified unfair practices in order to gain an advantage over competitors or to mislead consumers.

b) protect consumers from fraudulent business practices, defective products, and dangerous goods and services.

Article 46 of the Constitution of Kenya 2012

which enshrines the following fundamental rights for consumers in Kenya:

  • Goods and services of reasonable quality;
  • Information necessary to enable consumers gain full benefit from goods and services;
  • Protection of consumer health, safety and economic interests;
  • Compensation for loss or injury arising from defects in goods or services

Whose purpose is to promote and advance the social and economic welfare of consumers in Kenya by protecting them from unfair trade practices in consumer transaction, stipulating consumer rights and obligations as regards product and service liability, providing for the promotion and enforcement of consumer rights and enabling consumers to seek redress for infringement of their rights, including through compensation.
